Welcome

Welcome to SeaTheShips, an on-line community for anyone with an interest in Ships and/or the Sea; a place for stories (and photographs) of years ago, of yesterday and those yet to happen; i.e. it is about the Ancient, the Old and the Modern; for the Ancient can teach the Modern, and the Ancient can learn from the Modern. The memories and experiences of those connected to the Sea in the past are far too precious to be lost; as indeed are those of today’s mariners; whose potent and intelligent voices are vital for the safety and wellbeing of the maritime community today, and SeaTheShips is a website created to secure a lasting future for these memories, comments, records and observations.

SeaTheShips is a move by a group of people to try and put back into life, what life has given to them; to leave the world a better place for having travelled through it, to be a monument to the worthwhile issues associated with the sea; be those the comments of the old and salt-stained seadog, or the new, enthusiastic and quick-witted seafarer of today.

To either reassure or otherwise, but in any event to clarify, a few words about the website:

SeaTheShips is:

  • A place where worthwhile text and photographs are added for the benefit of all.
  • A forum to pass on and or gain knowledge.
  • A community that seeks to provide support for those whose lives are, or have been, touched by ships and the sea.

SeaTheShips is NOT:

  • A social networking centre for people who merely wish to either abuse each other, or concentrate solely on the baser instincts of mankind.
  • A forum for the uninformed to sound off about things they know nothing about.
  • A dumping ground for snap-shots of loutish behaviour.

There is below the inevitable legally worded “Terms and Conditions of Use”, which for the good of all, you are asked to read, understand and accept. But before you do, a few words to explain the ethos of StS in plain language.

  • Please treat others as you would like others to treat you; respect and politeness are not only both vital and precious things, they also help us to enjoy life and to gain from it.
  • If you are kind enough to upload a picture that is yours, please do so in the knowledge that whilst you retain the copyright we really do not want copyright logos on the pictures – they have no place on the StS site.
  • Just because the pictures are placed on StS and are thereby freely available without any copyright markings, it does not give anyone the right to take them and use them for their own gain. StS will put as much effort, if not more, into tracking down those that abuse the system, as they will in making sure the pictures are free from copyright logos. So, as a fundamental guideline of the StS site; just because one can download and use them, does not permit you to do so for any reason other than purely your own private use – any other use of the pictures or the text will be regarded as unfair, illegal and unacceptable and will be dealt with accordingly.

Terms and Conditions of Use

These terms set out the basis on which you may use www.SeaTheShips.org.uk (“SeaTheShips”). By using SeaTheShips you indicate your acceptance of, and agree to be legally bound by and abide by, these terms which shall take effect immediately on your first use of SeaTheShips. If you do not agree to be legally bound by all the following terms, please do not access or use SeaTheShips.

1. About Us

SeaTheShips is operated by Pacific Island Navigation Limited (trading as SeaTheShips), which is a limited company registered in England and Wales with company number 04817482 and whose registered office is The Director General's House, 15 Rockstone Place, Southampton, Hampshire. SO15 2EP (“We”, “Our”, “StS” or “Us”).

2. Accessing SeaTheShips

2.1 Access to SeaTheShips is permitted on a temporary basis, and We reserve the right to withdraw or amend the service We provide without notice. We will not be liable to you if, for any reason, SeaTheShips is unavailable at any time or for any period of time.

2.2 From time to time, We may restrict access to some parts of SeaTheShips, or SeaTheShips in its entirety, to users who have registered with Us.

2.3 If you choose, or you are provided with, a user identification code, password or any other piece of information as part of Our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. All SeaTheShips users hereby accept all risk from others accessing or misusing their membership as a result of the user’s failure to comply with this clause 2.3 Users agree to notify StS immediately if any misuse of their username/password is occurring.

2.4 StS have the right to disable any user identification code or password, whether chosen by you or allocated by Us, at any time, if in Our opinion a user has failed to comply with any of the provisions of these terms.

2.5 You are responsible for making all arrangements necessary for you to have access to SeaTheShips. You are also responsible for ensuring that all persons who access SeaTheShips through your internet connection are aware of these terms, and that they comply with them.

3. Intellectual Property Rights

3.1 We are the owner or the licensee of all intellectual property rights in SeaTheShips, and in the material published on it (except for material published by users of SeaTheShips). All such materials are protected by copyright laws and treaties around the world. All such rights are reserved.

3.2 You may print off one copy, and may download extracts, of any page(s) from SeaTheShips for your personal reference.

3.3 You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

3.4 Our status (and that of any identified contributors) as the authors of material on SeaTheShips must always be acknowledged.

3.5 You must not use any part of the materials on SeaTheShips for commercial purposes without obtaining a licence to do so from Us (or from any other identified contributor) or Our licensors.

3.6 If you print off, copy or download any part of SeaTheShips in breach of these terms, your right to use SeaTheShips will cease immediately and you must, at Our option, return or destroy any copies of the materials you have made.

4. Reliance on Information Posted

Commentary, information and other materials posted on SeaTheShips are not intended to amount to advice on which reliance should be placed by any person. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any user of SeaTheShips, or by anyone who may be informed of any of its contents.

5. Changes to SeaTheShips

We aim to update SeaTheShips regularly, and may change the content at any time. If the need arises, We may suspend access to SeaTheShips, or close it indefinitely. Any of the material on SeaTheShips may be out of date at any given time, and We are under no obligation to update such material.

6. Liability

6.1 The material displayed on SeaTheShips is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, We and third parties connected to Us hereby expressly exclude:

6.1.1 all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity; and

6.1.2 any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with SeaTheShips or in connection with the use, inability to use, or results of the use of SeaTheShips, any websites linked to it and any materials posted on it, including, without limitation any liability for loss of income or revenue, loss of business, loss of profits or contracts, loss of data, loss of goodwill, wasted management or office time and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

6.2 This clause 6 does not affect Our liability for death or personal injury arising from Our negligence, nor Our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law

7. Privacy Policy

7.1 We process information about you in accordance with Our Privacy Policy. By using SeaTheShips, you consent to such processing and you warrant that all data provided by you is accurate.

7.2 In addition to reserving the right to disclose your details (including any material you post on SeaTheShips), in accordance with Our Privacy Policy we hereby put you on notice that, in the event of a complaint relating to any potentially defamatory material and/or material that otherwise breaches these terms, it is the policy of StS not to oppose an application to a court for the disclosure of personal data relating to SeaTheShips. However, it is StS's policy not to disclose such data unless such an order is sought; or disclosure is permitted in accordance with the StS Privacy Policy; or its disclosure is permitted by reason of any exemption in the Data Protection Act 1998 (which includes, amongst other things, the right to disclose suspicious content to the authorities). Please think carefully before you post any material on SeaTheShips.

8. Use of SeaTheShips

8.1 You may not copy, reproduce, republish, download, post, broadcast, transmit or otherwise use SeaTheShips’ content in any way except for your own personal, non-commercial use. You also agree not to adapt, alter or create a derivative work from any part of SeaTheShips content except for your own personal, non-commercial, use. Any other use of SeaTheShips content requires the editor's (or identified contributor’s) prior written permission.

8.2 All users of SeaTheShips agree not to post any item, photograph, video or link to content that:

  • Is defamatory, or discloses information that the user has no legal right to disclose, or is otherwise illegal;
  • Is (or contains anything which is) vulgar, vengeful, malevolent, offensive, unlawful, obscene, profane, threatening or insulting;
  • Is intended to impersonate another person, logo, trade mark or entity;
  • Contains any form of advertising, promotional material or commercial activity;
  • Contains any, or links to, any virus, corrupted files, "Trojan Horses", key loggers or any other malicious code or material that could cause harm to the computer, data or financial security of StS or any third party;
  • Contains any, or links to, any intentionally false or misleading statements;
  • Is protected by any form of intellectual property, whether registered or unregistered, or any contractual, statutory and equitable obligations of confidence or which breaches the intellectual property rights of any person, or any licence to use such rights;
  • Is or may amount to collusion or activities of a suspicious or criminal nature.

8.3 Material submitted to SeaTheShips is accepted on the understanding that it is the right of the user/contributor to make the submission and that there are no legal restrictions preventing its submission or publication on-line or in any other media StS may utilise.

8.4 Material that has been accepted for publication by SeaTheShips may not subsequently be withdrawn by the user without good reason and the agreement of the editor. However, material may be removed by the editor at any time and without giving a reason.

8.5 StS has no obligation to check the accuracy, lawfulness, completeness or truth of any information or image posted in the forums. A procedure is provided by StS for notification of objectionable post or images and, upon notification, StS will act expeditiously to remove any such material if, in its absolute discretion, it believes it is appropriate to do.

8.6 For the wellbeing and security of all, SeaTheShips has controls in place to monitor the use of the SeaTheShips’ servers. StS reserves the right to delete or refuse any posting and/or to suspend or terminate any user’s SeaTheShips membership for any reason and at any time (without notice). StS may revoke a user’s membership rights if he or she acts outside the guidelines set out in these terms.

9. Uploading Material to SeaTheShips

9.1 Whenever you make use of a feature that allows you to upload material to SeaTheShips, make comments or make contact with other users of SeaTheShips, you must comply with reasonable standards of acceptable use. You warrant that any such contribution does comply with reasonable standards, does not infringe the intellectual property rights of any person, is not offensive, indecent or defamatory and you indemnify Us for any breach of this warranty.

9.2 Any material you upload to SeaTheShips will be considered non-confidential and non-proprietary, and We have (and you hereby grant Us) the right a licence to use, copy, distribute and disclose to third parties any such material for any purpose. We also have the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to SeaTheShips constitutes a violation of their intellectual property rights, or of their right to privacy.

9.3 We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of SeaTheShips.

10. Viruses, Hacking and Other Offences

10.1 You must not misuse SeaTheShips by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to SeaTheShips, the server on which SeaTheShips is stored or any server, computer or database connected to SeaTheShips. You must not attack SeaTheShips via a denial-of-service attack or a distributed denial-of service attack.

10.2 By breaching this clause 10, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and We will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use SeaTheShips will cease immediately.

10.3 We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of SeaTheShips or due to your downloading of any material posted on it, or on any website linked to it.

11. Linking to SeaTheShips

11.1 You may link to our home page (provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it) but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on Our part where none exists.

11.2 You must not establish a link from any website that is not owned by you.

11.3 SeaTheShips must not be framed on any other website, nor may you create a link to any part of SeaTheShips other than the home page. We reserve the right to withdraw linking permission without notice. The website from which you are linking must comply in all respects with reasonable standards of acceptable use.

12. Links from SeaTheShips

Where SeaTheShips contains links to other websites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those websites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

13. Indemnity

You hereby agree to indemnify and hold SeaTheShips harmless against all costs, claims, liability or damage (including solicitor/client costs) resulting directly or indirectly from your breach of these terms.

14. Variations

We may change these terms at any time by amending this page. Please review this page regularly to ensure you are aware of any changes made, as they are binding on you. Some of the provisions contained in these terms may also be superseded by provisions or notices published elsewhere on SeaTheShips.

14. Variations

The English courts will have exclusive jurisdiction in respect of any claim arising from, or related to, a visit to SeaTheShips although We retain the right to bring proceedings against you for breach of these terms in your country of residence or any other relevant country. These terms are governed the law of England and Wales.

Although the administrators and moderators of Sea the Ships - A community for maritime enthusiasts will attempt to keep all objectionable messages off this site, it is impossible for us to review all messages. All messages express the views of the author, and neither the owners of Sea the Ships - A community for maritime enthusiasts, nor vBulletin Solutions, Inc. (developers of vBulletin) will be held responsible for the content of any message.

By agreeing to these rules, you warrant that you will not post any messages that are obscene, vulgar, sexually-oriented, hateful, threatening, or otherwise violative of any laws.
